As a teenager, Burgess moved with his family from the Oklahoma Territory to the state of Washington, settling between the towns of Palouse and Colfax. In 1909, Burgess received his A.B. from Pacific College in Oregon, and the following year received his Bachelor of Science degree in Economic Science and History from the State College of Washington (now Washington State University). After serving a year as the Principal of Sprague High School, Burgess attended the University of Pennsylvania and obtained his law degree in 1914. In 1915, he married Ruth Wayland and began work with the Lehigh Railway Company in New York. Through 1942, he served as the Assistant General Solicitor and the General Solicitor, before becoming the Chairman of the Truck Line Association (1942-1946), and the Chairman of the Civilian Components Policy Board of the U.S. Department of Defense (1950-1951). Burgess was appointed the Vice-President and General Counsel for the B and O Railroad Company in 1946, and remained there until his retirement in 1958.
